Change of Ownership

We’ve listed some of the circumstances that often result in changes affecting the interest owner. Please note there may be variations in laws outside of the general guidance listed below according to differing jurisdictions where the property is located.

Complete change of address form and return with signature and SSN to Division Order Department (Download Address Change Form Here)

Name change due to marriage, divorce:
Recorded Marriage Certificate, Divorce Decree specifying name change or other documents affecting name change

Merger or change to corporation or company name:
Certificate of Name Change, Certificate of Merger and Executed W9 (Download W-9 Form)

Appointment of Attorney-In-Fact:
Power of Attorney

Transfer of Interest (Sale of Interest):
Conveyance document recorded in county/parish in which property is located

Trusts and Partnerships:
Conveyance of interest into or out of trust/partnership recorded in county/parish in which property is located, copy of trust/partnership agreement, instruments pertaining to successor trustee, and executed W9 (Download W-9 Form)

Death of Interest Owner

A. Owner death with a will (Testate) and probate is conducted in state where the property is located:

  • All States – Death Certificate, Letters of Testamentary, Last Will and Testament*
  • Texas – Order Admitting Will to Probate*
  • Louisiana – Judgment of Possession*
  • Kansas – Final Entry of Judgment*
  • Oklahoma – Final Decree of Distribution

*All documents to be recorded in the real property records of the county where the property is located.

B. Owner death with will, but probate is not conducted in the state where property is located:

  • Texas – Death Certificate, Letters of Testamentary, Last Will and Testament, Order Admitting Will to Probate (probated outside of Texas)*
  • Louisiana – Death Certificate, Letters of Testamentary, Last Will and Testament, Judgment of Possession (from another state)*
  • Oklahoma and Kansas – Death Certificate, Affidavit of Death and Heirship Form (attach Proof of Death and Heirship Affidavit form)

*All documents to be recorded in the real property records of the county where the property is located.

C. Owner death without will (Intestate):

  • All States – Death Certificate, Affidavit of Death and Heirship Form* (attach Proof of Death and Heirship Affidavit form)

D. Life Tenant death:

  • Death Certificate

E. Joint Tenant death:

  • Death Certificate
